Do we need attorneys to use mediation?
You can participate in mediation with or without attorneys. Because the mediator must remain neutral, the mediator cannot represent either spouse or provide individual legal advice.
You may consult an independent attorney before, during, or after mediation if you have questions about your legal rights or would like an agreement reviewed.
What if we cannot agree on everything?
Mediation does not require either person to accept terms they believe are inappropriate. If you resolve only some of the issues, those decisions may be documented as a partial agreement.
You may schedule another mediation session, consult your attorneys, or ask the court to decide the remaining issues. Even a partial agreement can reduce the time, expense, and conflict involved in completing a divorce.
